COPY OF GUARANTEE GIVEN TO TRIUMPH DEALERS W E give th e following guarant ee with our moto r cycles, motor cycle combin atio ns and side cars including all accesso ries and cornpone nt par ts ot her than t yres . saddles , chains and light ing and electr ical equip ment , and other than accessorie s and component parts supp lied to th e order of th e Purchaser and differing from thos e comprised in t he sta ndar d specifications supplied with our motor cycles, mot or cycle combinations and sidecars, but includ ing accessories and par ts supp lied by way of exch ange as hereinaf te rprovided. This guara ntee is given in place of any implied cond ition s or warrant ies or any liabilities whatsoeve rstatut oryor oth erwise ; no gua rantee excep t t hat herein after contained and no cond itions or warranty whatso ever st at uto ry or othe rwise is given or is to be implied , nor ar e we to be under any liability whatsoeve r except unde r t he guarant eeher eina fter cont ained. Any stat ement, descript ion, condition or representation cont ained in any catalogue , adver tise ment , leaflet or other publication shall not be construed as enlarging, varying or overriding anything herein ,contained. ln the case of machines (a) whi ch have been used for "hi ring out" purposes or (b) any motor cycle and/or sidecar used for any dirt tra cks, cinder track or grass track racing or competitions (or any competition of any kind within an enclosure for which a cha rge is made for admission t o t ake part in or view th e comp et ition) or (e) machin es frorn which the trade mark , name or manufactur ing numb er has been altere d or remove d or (d) any machines in which par ts have been used not supplied by or approved by th e moto r cycle manuf actur er, or (e) any machi ne from which th e silenc ing system as fitt ed by the manuf acturer has bee n part ially or wholly removed or int erfered with, no guarantee , condi tion or warranty of any kind st at ut ory or other wise is given or is to be implied nor are we to be under any liability what soever in respect of any such mach ine. W e guarantee, subject to the cond itions mention ed below, th at all precautions which ar e usual and reaso nable have been t aken by us to secur e exc ellence of mater ials and workmanship, but t his gua rante e is to ext end and be in force for six month sonly from · dat e of purchase, or dat e of ex change in case of any accessor yor part supplied by way of exchange as herein afterprovided, and damages for which we make ourselves responsib le under this guarantee are limited to th e fr ee re pair of or supp ly of a new part or accessor y in exchang e for the part of t he motor cycle, motor cycle combint aionor side car or accessory whic h may have proved defect ive. We undertake , subject to the cond itio ns ment ione d below, to make good in manner aforesaid any part or accessory covered by this guarantee which has proved defective wit hin the said period of six months . We do not undertake to replace or reflx , or bear th e cost of rep lacing or refìxing any such new part or accessory in the motor cycle, mot or cycle combination or si cecar. As moto r cycle s, motor cycle combin ations and side cars are easily liable to dera ngement by neglect or misuse, th is guarantee does not apply to defects caus ed by we ar and tea r, misuse or neglect. The term "m isuse" shall include amongs t oth ers, the follow ing acts :- . I. The att aching of a sidecar t o a motor cycle in such a manner as t o cause damage or calculated to render the lat ter unsafe when ridden. 2. The use of a motor cycle or of a mot or cycle and sidecar combined, when carrying mor e person s or a gre ate r weight th an that for which the machine was desig ned by the manufact ure rs. 3. The att aching of a sidec arto a moto r cycle by any form of at tachmen tnot prov ided, supplied, or approved by the manufactur ers, or to a moto r-cycle which is not des igned for such use. We do not guaran te e tyres, saddles, chains or lighting and elec trical equipment, or any accesso ries or compon ent parts supp lied to t he ord er of th e Purchaser differing from t hose comprised in the stand ard specifications supplied wit h our motor cycles, motor cycle combin ations or sidecars. As reg ards all such tyres ,saddles, chains, light ing and electr ical equipment , accessor iesand component parts, no guarante e, condition or war ranty of any kind st at utory or otherwis e is given or is to be implied, and we are to be under no liability whatsoev er in res pect thereof. 85
