GUARANTEE W E give the following gua .rantee wit h our mo t or cycles, motor cycle combinations and sidecars including all accessor ies and component parts ot her t han ty res, saddles, chains and lighting and electrical equipment, and othe r tha n accessories and compone nt parts sup plied to the orde r of th e Purchaser and differin g from t hose comprised in the sta ndard specifications supplied with our motor cycles, motor cycle combinations and sidecars, but including accessories and parts suppl ied by way of exchange as hereinafter provided. This guaran tee is given in place of any implied condit ions or warra nties or any liabilities whatso ever statutory or otherwise ; no guarantee except tha t hereina fter contained and no conditions or warranty whatsoever statutory or oth erwise is given or is to be imp lied, nor are we to be under any liabilit y whatsoever except under the guarantee hereina fter contained. Any st ateme nt ,descript ion,condit ion or representa tion contained in any cata logue, adve rtisement, leaflet or ot her pub licat ion shall not be construed as enlarging, varying or overriding anything herein contained. ln the case of machines (a) which have been used for " hiring out" purposes or (b) any moto r cycle and/or sidecar used for any dirt trac ks, cinde r tr ack or grass track racing or compet itio ns (or any competition of any kind within an enclosu re for which a charge is made for adm ission to take part in or view the competition) 'or (e) machines from whic h the trade mar k, name or rnanufact uring number has been alt ered or removed or (d) any machines in which parts have bee n used not supplied by or approve dby the mot or cycle manufacturer ,or (e) any machine fr om which the silencing system as fitted by the manufactu rer has been partia lly or who lly removed or interfered with, no guarantee, condition or warranty of any kind statutory or otherwise is given or is to be implied nor are we to be under any liability whatsoever in respect of any such mach ine. We guarantee , subject t o the conditions mentio nedbelo w,tha tall precaut ions which ar e usual and reasonab le have been take nby us to secure exce llence ofmater ials and workmanship, but this guarantee is to extend and be in force for six months only in t he U.K. and ninety days overseas from date of purchase, or date of exc hange in case of any accessory or part supplied by way of exchange as here inafter provided, and damages for which we make ourselves responsib le under this guarante e are limite dto the free repa ir of or supply of a new part or accessory in excha nge for the part of the moto r cycle, mot or cycle combinatio nor side car or accessory which may have proved de fective. We undertake, subject to the conditions mentioned below, to make good in manner aforesa id any part or accessory covered by this guara nt eewhich has proved defective wit hin the said per iod of six months. We do not undertake to replace or reftx, or bear the cost of replacing or refìxing any such new part or accessory in t he motor cycle , motor cycle combination or sidecar . As motor cycles, motor cycle combinations and sidecars are easily liable to derangement by neglect or misuse, this guarantee does not app ly to defects caused by wear and tear, misuse or neglect . The te rm "misuse" shall include amon gst ot hers the following acts :- I. Th.e attaching of a sidecar to a motor cycle in such a manner as to cause damag e or calculated to ren der the latter unsafe when ridden. · 2. The use of a motor cycle or of a motor cycle and sidecar comb ined, when carry ing more persons or a greater weight than that for which the machine was designed by the manufacturers . 3. The attach ing of a sideca r to a moto rcycle by any form of attachmen t not provided , supplied, or approv ed by the manufacturers ,or to a motor -cyclewhich is no t desig ned for such use. We do not gua rantee tyres, saddles, chains or lighting and elec trical equ ipment, or any accesso ries or componen t parts suppl ied to the or der of the Purc haser differi ng fro m those comprised in t he standa rdspecifications supplied wit h our moto rcycles, motor cycle combinations or sidecars . As regards all such tyres, saddles, chains, light ing and elec trical equipment , accessories and component parts, no guarantee , condition or warranty of any kind statutory or ot herw ise is given or is to be implied, and we are to be unde r no liability whatsoever in respect thereof . 134
