I. The attach ing of a sidecar to a motor cycle in such a manner as to cause damage · or calculated to render the latter unsafe when ridden. 2. The use of a motor cycle or of a motor cycle and sidecar combined, when car rying more persons or a greater weight than that for which the machine was designed by the manufacturers. · 3. The attaching of a sidecar to a motor cycle by any form of attachment' not provided, supplied, or approved by the manuf acturer s, or to a motor-cycle which is not designed for such use. GUARANTEE W E give the following guarantee .with our motor cycles, motor cycle combinations and sidecars including all accessories and component parts other than tyres, saddles, chains and lighting and electr ical equlpment, and other tha n accessories and componen t parts supplied to the order of the Purch aser and differing from tho se comprised in. the standard specifications supplied with our motor cycles, motor cycle combin ations and sidecars, but including accessories and parts suppli ed by way of exchange as herein after provided. This guarantee is given ln place of any implied conditions or warran ties or any liabilities what soever statutory or otherwise ; no guarantee except that hereinafter cont ained and no conditio ns or warr ant y whatsoever statutory or ot herwise is given or is to be implied, nor are we to be under any liability whatsoever except under the guarantee her einafter .conta ined. Any statem ent, description, condition or representation contained in any cat alogue, advertisement, leaflet or other publication shall not be construed as enlarging, varying or overr iding anything herein contained . ln th e case of machines (a) which have been used for "hiring out" purposes or (b) any motor cycle and/or side car used for any dirt tr acks, cinder tr ack or grass track racing or competi t ions (or any competition of any kind within an enclosure for which a charge is made for admission to t ake part in or viewthe compe titi on) or (e) machines from which the tr ade mark, name or manufacturing number has been altered or removed or (d) any machin es in which parts have been used not supp lied by or approved by the motor cycle manufact urer, · or (e) any machine from which the silencing system as fitted by the manuf actur er has been partially or wholly removed or interfered with, no guarantee, condition or warranty of any kind statutor yor otherw ise is given or is to be implie d nor are we to be under any liability whatsoever in respect of any such machine . We guarantee, subjec t to the condit ions ment ioned below, that all precautions which are usual and rea sonable have been taken by us to secure excell ence of materia ls and workmanship. · but this guarantee is to ex te nd and be in force for six months only in the U.K. and ninety days overse as from date of purchase, or date of exchange in case of any accessory or part supplied by way of exch ange as herei nafter provid ed, and damages for which we make ourse lves responsi ble under th is guarantee are limited to the free rep air of or supply of a new part or accessory in exchange for the part of the mot or cycle, motor cycle combinat ion or side car or accessory which may have proved defective . · We undert ake, sub ject to the condit ions mentioned below, to make goo d in manne r aforesaid any part or accessory covered by this guarantee which has proved defect ive with in the said period of six months . We .do not undert ake t o replace or refìx, or bear the cost of rep lacing or refixing any such rìèw part or accessory in the motor cycle, motor cycle combinat ion or sidec ar. As motor cycles, motor cycle combinat ions and sidecars are easily liable to derangement by neglect or misuse, this guarantee does not apply to def ect s caused by wear and tear, misuse or neglect. The te rm "mi suse" shall include among st ot hers the following acts :- We do not guar antee tyres , saddles, chains or lighting and electr ical equipment, or any accessor ies or comp onent parts supplied to the order of the Purchaser differing from those compr ised in the stand ard specifications supplied with our motor cycles, motor cycle comb inations or sidecars . As reg ards all such tyres, saddles , chains, lighting and electrica l· equipment, accessories and compone nt parts, no guara ntee, condition or warranty of any kind statutory or otherw ise is given or is to be implied, and we are to be under no liability whatsoever in' resp ect thereof. 1 4 .I
